Modern-day language likes acronyms. In particular, mediation centers around the acronym BATNA, which stands for an individual's Best Alternative To a Negotiated Agreement.


The Negotiated Agreement is where Alternative Dispute Resolution (ADR) shines. A Negotiated Agreement is one that you and the opposing party in your dispute both agree to be bound by. A Negotiated Agreement has no associated court costs, can be executed as soon as both parties can come to agreement, and can take a more flexible approach to addressing the interests that are most important to you.


If your Best Alternative To a Negotiated Agreement is one that you don't like (extended Court proceedings, high legal fees, an dispute that remains unresolved for months on end, etc...) then you need to consider entering into mediation to achieve a Negotiated Agreement.


Best of all, using mediation does not forestall any other solution; if mediation doesn't end successfully all of your other options remain open to you.
